Nature of the Service

This private reference site has no authority over a sheriff, jail, court, or corrections agency. It does not maintain official records, confirm whether a person is in custody, arrange a release, change a booking entry, or submit a filing on anyone’s behalf.

Its pages direct visitors toward Avery County and North Carolina inmate, jail, booking, and court resources. Some search features connect to independently operated research services. Those tools remain separate from Avery County Recent Arrests.

Acceptable Use

• Use the site only in ways permitted by applicable law.
• Do not use any information to stalk, threaten, intimidate, or harass another person.
• Do not rely on site content for employment, housing, lending, credit, or insurance decisions.
• Do not seek access to accounts, servers, data, or features without authorization.
• Do not deploy bots, scrapers, crawlers, or other automated collection tools.
• Do not interfere with the site’s operation or another visitor’s ability to use it.

No Consumer Reports

Avery County Recent Arrests is not a consumer reporting agency under the Fair Credit Reporting Act. Neither the site nor its advertising partners supplies background checks, credit reports, consumer reports, or screening services. By using the site, a visitor agrees not to use its content for any FCRA-covered purpose, including:

• Decisions about hiring, continued employment, discipline, or termination
• Tenant selection, leasing, or any other housing decision
• Creditworthiness, lending terms, or insurance eligibility and premiums
• Licensing, permits, or eligibility for a government benefit or program
• Any other decision governed by the FCRA or similar consumer-reporting law

Links may lead to jail rosters, booking feeds, sheriff and corrections pages, court or government portals, legal-aid resources, and outside search services. Those destinations control their own content, availability, security, and data practices. A link is provided for convenience and is not an endorsement. Review each destination’s terms and privacy policy before using it.

No Warranties

The site and all information available through it are provided “as is” and “as available.” No express or implied warranty is made concerning:

• The accuracy, completeness, or current status of any information
• Continuous or uninterrupted access to the site
• Freedom from errors, defects, harmful code, or security weaknesses
• The scope, quality, or completeness of results supplied by a partner

Custody status, charges, court events, and public records can change at any time. Nothing published here is an official statement by the Avery County Sheriff’s Office, a court, a jail, NCDAC, or another government agency. Verify material facts with the office that created the record.

Liability Limits

To the fullest extent allowed by law, Avery County Recent Arrests and its owners, operators, contributors, and partners will not be liable for direct, indirect, incidental, special, consequential, or punitive losses arising from access to, use of, inability to use, or reliance on the site or an outside service.

Indemnification

A visitor agrees to defend, indemnify, and hold harmless Avery County Recent Arrests, its owners, operators, contributors, and partners from claims, liabilities, losses, and expenses, including reasonable legal fees, that arise from the visitor’s use of the site or violation of these terms.

Intellectual Property

Unless a source is identified otherwise, the site’s original text, graphics, logos, design elements, and code belong to Avery County Recent Arrests or its content partners. They may not be copied, republished, distributed, adapted, or modified without prior written permission. Rights belonging to government offices and outside publishers remain with their respective owners.

Changes to These Terms

These terms may be revised at any time. A revised version becomes effective when it is posted here. Continued use after posting means the visitor accepts the updated terms.

Ending Access

Access to all or part of the site may be suspended, restricted, or revoked at any time, for any reason, and without advance notice. This right includes action taken to address misuse, protect the service, or comply with law.

North Carolina Law

These terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles. Any dispute must be brought in a court with proper jurisdiction in North Carolina.

Severability

If a court finds one provision invalid or unenforceable, the remaining provisions will continue in effect. The affected provision will be limited or adjusted only as much as needed to make it enforceable.
